Vincent F. O’Flaherty

Mr. O’Flaherty has been representing clients for over 35 years throughout the United States and internationally.  Mr. O’Flaherty has a broad base of litigation and business transaction experience.  He has particular knowledge of all aspects of the broadcast and cellular/wireless tower industries.  Mr. O’Flaherty has represented clients in the communications industries since 1988.   

Mr. O’Flaherty also has litigation clients in a wide variety of industries including real estate, construction, bankruptcy and employment relations.  He has extensive jury trial experience in multiple areas of insurance claims including product liability, wrongful death, premises liability, environmental claims, professional liability, medical malpractice, nursing home negligence, legal malpractice, construction defects, automobile negligence, trucking negligence, directors and officers fiduciary liability, bad faith, insurance agent and broker negligence, and related personal injury matters.

He has first chair jury trial experience having tried cases in state and federal district courts throughout the United States.  He has tried cases in the major metropolitan areas including Kansas City, St. Louis, Branson, Springfield, Missouri, and Kansas City, Olathe, Wichita, Lawrence, Topeka, Kansas and numerous outlying areas.  He has also traveled outside the two state region and tried jury trials in numerous other locations including Washington, D.C., Lexington, Kentucky, Dallas, Texas, Oklahoma City, Oklahoma, Houston, Texas, Omaha, Nebraska, Miami, Florida and other areas. 

He has been admitted to practice in the United States District Courts of the District of Kansas and Western District of Missouri and the 4th, 6th, 8th and 10th Courts of Appeal.  Mr. O’Flaherty has also been granted permission by courts in other federal district courts to try lawsuits including the District of Nebraska, Western District of Oklahoma, Northern District of Iowa, District of South Carolina, Eastern District of Virginia, Southern District of Mississippi, Eastern District of Kentucky and Southern District of Florida.

He also has handled significant coverage litigation on behalf of insurance companies throughout the United States.  He has experience in handling and trying reinsurance disputes between reinsureds and their reinsurers.

He has been appointed Special Master by the District Court of Johnson County, Kansas for the sale and refinancing of a multimillion real estate portfolio in a divorce proceeding of a major developer in Southern and Western Johnson County, Kansas.  Mr. O’Flaherty, along with his father Michael O’Flaherty, successfully released over $12 million in funds to satisfy the divorce decree in a period of nine months.

Mr. O’Flaherty has also been appointed as special master and receiver on multiple occasions by the District Court of Johnson County, Kansas, to take control of and operate businesses, while litigation over ownership is decided by the courts.

Mr. O’Flaherty has served as an arbitrator in multiple construction and insurance disputes.

Mr. O’Flaherty has a hands on approach and handles matters personally with an experienced trial staff.  He understands the need to provide clients with early case assessment and evaluation in major and complex litigation.

Mr. O’Flaherty also has extensive appellate experience handling and arguing matters with all of the courts of appeal in the states of Missouri and Kansas, Kansas Supreme Court, the Eighth Circuit Court of Appeals, Tenth Circuit Court of Appeals, Sixth Circuit Court of Appeals and Virginia Supreme Court.
